SECTION: DISPUTE RESOLUTION
In the event of any claims, disputes, or controversies arising out of or relating to these Terms of Service, the use of this website, or any information obtained through it, you agree to resolve such disputes by submitting them to JAMS, a dispute resolution firm, through its offices located in Helsinki, Finland, or its successor, for mediation (see www.jamsadr.com/james-helsinki). Any party may initiate mediation by providing a written request outlining the subject of the dispute and desired relief. The parties must cooperate in selecting a mediator from JAMS’ panel and schedule mediation within 30 days. All parties agree to participate in good faith and share the costs equally. All communications during the mediation process are confidential and privileged.
If the dispute remains unresolved after mediation, it will proceed to binding arbitration under JAMS’ Comprehensive Arbitration Rules. Arbitration will be conducted by one arbitrator, chosen by mutual agreement or appointed by JAMS if the parties cannot agree within 30 days. All hearings will be held in Finland. Should JAMS cease to exist, the parties will turn to another alternative dispute resolution provider in Finland. A party may initiate arbitration 45 days after mediation is requested or after the first mediation session. The mediator cannot serve as the arbitrator unless all parties agree otherwise. Courts may enforce the arbitration provisions, and the prevailing party is entitled to recover costs, including attorney’s fees.
IMPORTANT: By agreeing to arbitration, you waive your right to a jury trial.
Disputes must be resolved individually and cannot be consolidated or joined with other disputes. Failure to enforce strict performance of these Terms does not constitute a waiver of rights. Any claim or cause of action related to the website must be filed within two years of its accrual. If any part of these Terms is found unenforceable, it does not impact the validity of the remaining provisions.
These Terms, along with the Privacy Policy, represent the entire agreement between the parties. We reserve the right to update these Terms, and any additional terms governing specific items will control those items.
